June 07, 1898: “TheSpangler mines are situated about seven miles north of Garden station. Theyconsist of twelve claims, belonging to the Spangler Bros., who have done andare now doing good, substantial work on their properties. They have a two-stampmill, which they keep at work, at the same time going steadily ahead with theirdevelopment work. The reports received from there are very encouraging. 1. What am I purchasing with this sale? A 100% ownership interest in this mining claim, the exclusive rights to all gold, gems, rare earth, and minerals you find on the claim. Ownership of the land is not included.

2. What is a “Mining Claim”? A mining claim gives the claimant the exclusive rights to minerals on lands owned by the citizens of the United States. Mining claims are tangible assets; they can be bought, sold, traded, leased, gifted, or willed using a quitclaim deed.

3. What is the difference between a “Lode Claim” and a “Placer Claim”? A “Lode Claim” gives the claimant exclusive rights to minerals located in rock or veins; “Placer Claim” gives the claimant exclusive rights to minerals detached from the original location. Or another way to say this would be a “Lode Claim gives you subsurface mineral rights, often there are shafts or tunnels constructed, “Placer Claim” gives you surface or just below the surface mineral rights, often a river bed or stream bed.

4. Do I have to pay a royalty to the Federal Government for the gold or minerals I find? No! A mining claim is considered “Locatable” by the Government. Locatable means you own what you find!
