We advise all potential buyers to fully read andunderstand all of the information below before offerding. Please read all of this information andunderstand the terms and conditions outlined below.
Most of the questions you will have will probablybe answered below, saving time. If after reading below you still havequestions, please call us and we will attempt to resolve any outstanding issue,question, or problem.
Payment: If youpurchase an item from us, we will invoice you and you will have (3) days to payfor your purchased item. If you want topay via credit card, you may call us at [phone removed by ] for payment over thephone. If you pay via Pay Pal, you willbe responsible for the Pay Pal fee that will be added to your purchase priceowed to us.
What youare buying:
You are buying used farm equipment/items and orconstruction equipment/items. We do not sell new equipment/items. We purchase equipment/itemsfrom used equipment sources and resell. You should keep that in mind when youare offerding on an item. We describe all equipment/items to the best of ourability. We are not experts with each item/ equipment we sell, but we explainit the best we can and will attempt to answer questions you may have.
MachineSpecs:
All information we provide for items such as: Serialnumbers, weights, horsepower, and lift capacities, is taken from sourcesgenerally deemed to be accurate. We do not guarantee this information, howeverwe provide it as help to you. We may describe that a machine is supposed tolift 5,000 pounds, but if it only lifts 3,000 pounds it is not our fault and wedid not guarantee that. Likewise, if we tell you we believe a machine is a 1997and it is a 1995 model, we have not guaranteed the year as sometimes we have noway of verifying. If these things arethat important to you and if they will influence your decision to purchase, youshould call the manufacturer yourself or do your own research before entering aoffer. We do not lie and we do not deceive, but we are not experts on everythingthat we sell.
Hours andMileage:
We do not sell new equipment/items and everythingthat we handle is purchased from used equipment sources. Therefore, we cannotand do not guarantee the hours of service on any items we sell. We do guaranteethat we NEVER “turn back” hour meters or odometers. The information we reportfor an item is taken directly from the specific meter. If a machine shows lowhours or miles, etc. and does not appear to be correct, we will tell you.Otherwise, our information is from the machine and is not guaranteed to beaccurate.
Storage:
All items purchased from us can remain at ourlocation for 10 days following the close of the sale without incurring anyadditional charges. However, if an item remains at our location for more than10 days, you, the buyer, will be charged a storage fee. Such storage fees will differ depending on theitem purchased. If you are the winningoffer on an item, you will be notified.
SalesTax:
All sales are subject to Ohio Sales Tax at a rateof (7.5%). If you are “sales exempt”you must sign an Exemption Certificate and provide a Tax Exempt Vendor Number.
Shipping:
The buyer is responsible for all shipping costs andfor making shipping arrangements. We areselling used equipment/items. All equipment/itemswe sell are sold “As Is, Where Is”. Ifyou purchase equipment or an item and you have it delivered to your location,regardless of whether you have inspected it or not, you are responsible forthat freight charge. Freight charges, delivery fees, etc. are never refundablebecause of a defective machine because the equipment/items is used and it isbeing sold “As Is, Where is”. You always have the option of coming to ourlocation to check out the item in person before paying to have it delivered. Weare not responsible for any delivery costs.
All purchased items can be picked up at ourlocation by the purchaser or an authorized representative. We have a loader andlifts on site and a loading dock. We are open Monday thru Friday from 8:00 am to5pm EST. We advise that you call our location at [phone removed by ] to make pickuparrangements so that we can have the item ready when you arrive.
Terms ofSale:
We sell/offer for sale all items and equipment “AsIs, Where Is”. There are no warranties,guarantees, either expressed or implied on what we sell. If you are the highbuyer for an item, you have bought the item and the funds for your purchasewill be collected within 3 days from the close of the sale. Presumably youhave taken our advice and inspected the item before offerding so you know it iswhat you want. You are then responsible for moving the item from our lot toyour destination at your own expense. If an item will not load onto a truck oryour truck under its own power, we will either push it on the truck or we willuse a loader or forklift and load it onto your truck. You are then responsiblefor moving the item from our lot to your destination, at your own expense.There may be more things wrong with the item than contained in the description,and generally occur because they are hidden and cannot be seen when describingthem. If there is any part of the Terms of Sale discussion or of the “As Is, Whereis” Designation that is not fully understood, please call us for clarificationor do not offer.
We suggest, recommend, advise, etc. that allpotential buyers call us before offerding on any item if you have any questions.Please call [phone removed by ] and we will attempt to answer any questions. It isimportant that you ask your questions before offerding so that when you receiveyour item at the end of the sale you will not be surprised by something youdidn’t know. Please read all terms and conditions before offerding. Once you winthe offer, the item is yours and payment is required. At that time, you are obligated for the offerprice plus the cost of removing the item from our location to your location. Ifsomething happens to the item after the item is sold but before you pick it upor have it shipped, the responsibility for that is yours and not ours. Pleaseunderstand this or call for clarification.
To offer $15,000 or more, will sometimes requireyou to be “pre-approved”. This is an requirement rather than ours and itis for your own safety, if you do not offer that amount often. Please check with to determine if you need to be approved because there have been instancesin which buyers have missed an item they wanted at the last minute becausethey were not approved.
