Seller is not an authorized distributor.The seller (B-S Company, Inc.) hereby expressly disclaims any warranty expressed or implied: including any implied warranty of merchant-ability or fitness for a particular purpose, and the Seller, neither assumes nor authorizes any other person to assume for it any liability in connection with the sale of the merchandise. The seller specifically denies the adoption of any manufacturers express warranty. Seller shall not be liable for any injury, loss or damage, direct or consequential, arising out of the use of or the inability to use merchandise. buyer shall determine the suitability of the merchandise for its intended use and assumes all risk and liability whatsoever in connection with this determination. Buyer acknowledges that no warranty, representation, promises, or statements whatsoever with respect to the merchandise. Sales agreement provision: Seller, its agents, employees and other representatives have made no warranties, guarantees, representations or statements, express or implied to Purchaser that the materials transferred or to be transferred, pursuant to this agreement does not contain a \"hazardous substance\" as said term is defined in Sec. 101(14) of the comprehensive Environmental Response, Compensation and liability Act of 198042 U.S.C 9601(14) Purchaser hereby waives any and all claims against Seller, its agents, employees and their representatives for any type of loss or damage whatsoever in connection with said \"hazardous substance\" including but not limited to recovery for any injuries, damages, fires, court fees or attorneys fees under any Federal, State, or local law, rule ordinance or regulation, present or future, or pursuant to any written or oral agreements that it may have with any third parties or governments entities.
